IMPORTANT: PLEASE READ THE END USER LICENSE AGREEMENT (“EULA”) CAREFULLY BEFORE INSTALLING OR USING THE SMOOTHWIZARD APPLICATION.

1. Acceptance of Terms: By installing or using the SmoothWizard application (“Application”), the user acknowledges that they have read and accepted the terms of the EULA. If the user does not accept the terms of the EULA, they should not install or use the Application.

2. Grant of License: Upon acceptance of the EULA, SmoothWizard grants a non-exclusive, non-transferable, revocable license to install and use the Application on a single computer for private, non-commercial use.

3. Subscription Plans: SmoothWizard offers two subscription plans: the Basic Plan and the Pro Plan. Each plan provides access to different features and benefits, as described in detail on the SmoothWizard website.

4. Payments and Subscription Renewal: Payment for the selected subscription plan will be processed according to the terms presented during the transaction process. Subscription plans will be automatically renewed at the end of the billing period unless the subscription is manually canceled. The consumer is responsible for keeping payment information up to date.

5. License Distinctions:

• • Basic Plan: provides access to features associated with the Basic Plan, as described on the SmoothWizard website.

• • Pro Plan: provides access to features associated with the Pro Plan, as described on the SmoothWizard website.

6. Updates and Support: During the subscription period, the consumer is entitled to receive updates and technical support services related to the Application, as specified by the chosen subscription plan.

7. Termination of License: The license remains active until terminated. SmoothWizard reserves the right to terminate the consumer’s license or subscription at any time if there is suspicion of a breach of the EULA or subscription plan terms. Upon termination, the consumer must cease using the Application and delete all copies, full or partial, of the Application.

8. Ownership: The Application and all intellectual property rights are owned by SmoothWizard and associated licensors. SmoothWizard reserves all rights not expressly granted under the terms of the EULA.

9. Disclaimer of Warranties: THE APPLICATION IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability: TO THE EXTENT PERMITTED BY LAW, SMOOTHWIZARD AND ASSOCIATED LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THE APPLICATION OR SUBSCRIPTION.

11. Governing Law: The EULA is governed by and construed in accordance with Polish law, without regard to its conflict of law principles.

12. Entire Agreement: The EULA constitutes the entire agreement between the consumer and SmoothWizard regarding the Application and subscription plans and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings.

By installing or using the SmoothWizard application and subscribing to a plan, you acknowledge that you have read, understood, and agreed to the terms and conditions of this End User License Agreement and your chosen subscription plan.
