SmoothWizard Application License Agreement

Important: Please read this End User License Agreement (“EULA”) carefully before installing or using the SmoothWizard application.

1. Acceptance of Terms
By installing or using the SmoothWizard application (“Application”), you acknowledge that you have read this EULA and accept its terms. If you do not accept the terms of this agreement, you may not install or use the Application.

1A. Definitions

Application — the SmoothWizard software, including its components and updates, designed to function on compatible hardware (including Intel and AMD processors).

User — the individual or entity using the Application.

Basic Plan — the free version of the Application that does not require logging in.

Pro Plan — a paid subscription for extended features.

Trial Period — 3-day free access to Pro features without logging in.

Footprint — a unique device identifier generated based on hardware serial numbers for license management purposes.

Third-Party Software — components used under their own respective licenses.

2. Grant of License
Upon acceptance of this EULA, SmoothWizard grants the user a non-exclusive, non-transferable, revocable, and limited license to install and use the Application on a single device for private or business use, in accordance with the selected subscription plan.

3. Subscription Plans
SmoothWizard offers subscription plans, including Basic and Pro. Each plan provides access to specific features and services as described on the SmoothWizard website.

4. Payments and Subscription Renewal
Payment for the selected subscription plan is processed according to the terms presented at the time of purchase. Subscriptions renew automatically at the end of the billing period unless cancelled before renewal. The user is responsible for maintaining up-to-date payment information.

5. Scope of Plans

  • Basic Plan: is free and does not require registration or login.
  • Pro Plan: offers extended features in a subscription model.
  • Pro Trial: allows for 3-day use of Pro features without logging in.

 

6. Updates and Support
During the period of an active subscription, the user has the right to receive updates and technical support in accordance with the selected plan.

6A. Technical Data and Privacy

  1. The Application does not collect the user’s personal data.
  2. The only technical information processed by the Application is the Footprint identifier, generated based on the serial numbers of the computer’s hardware components.
  3. The Footprint is used solely for: license and trial period verification, and ensuring the correct operation of the Application’s functions.
  4. This data is not used to identify a natural person or for marketing purposes.
  5. The Application does not track user activity beyond what is necessary for the operation of system functions.

 

7. System Modifications and User Responsibility
The Application modifies operating system settings and hardware configuration parameters. The user acknowledges that system optimization involves risk. SmoothWizard is not responsible for system instability, incompatibility, performance changes, or data loss resulting from the use of the Application.

8. Termination of Agreement
The license remains in effect until terminated. SmoothWizard may suspend or terminate the license or subscription in the event of a breach of this EULA. Upon termination, the user must cease using the Application and delete all copies of it.

9. Ownership
The Application and all associated intellectual property rights belong to SmoothWizard and its licensors. All rights not expressly granted are reserved.

10. Restrictions
The user may not copy, modify, distribute, reverse engineer, or decompile the Application, except as permitted by applicable law.

11. Disclaimer of Warranty
The application is provided “as is”, without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights.

12. Limitation of Liability
To the maximum extent permitted by law, SmoothWizard shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of the application. The user performs system optimizations at their own risk.

13. Changes to the Agreement
SmoothWizard reserves the right to update or change this EULA at any time. Continued use of the Application after changes are introduced constitutes acceptance of those changes.

14. Governing Law
This EULA is governed by and interpreted in accordance with Polish law.

15. Entire Agreement
This EULA constitutes the entire agreement between the user and SmoothWizard regarding the use of the Application.

By installing or using the Application, the user confirms that they have read the content of this EULA, understand it, and accept its terms.

Third-Party Software & Open Source Credits

This application uses code snippets written by W4RH4WK in the system optimization section as part of certain scripts, licensed under the “BEERWARE LICENSE” (version 42):

“As long as you retain this notice, you can do whatever you want with this stuff. If we meet someday and you think this stuff is worth it, you can buy us a beer in return.”

For certain options and injecting settings into Nvidia drivers, Nvidia Profile Inspector (NPI) developed by Orbmu2k is used, operating under the MIT license.

NPI is not an official tool from NVIDIA, and its use is at your own risk.

To monitor temperatures and hardware specifications, SmoothWizard utilizes the LibreHardwareMonitorLib library. It is used in an unmodified form, in accordance with the Mozilla Public License 2.0 (MPL 2.0).

This library utilizes the PawnIo driver to obtain low-level access to hardware sensors (including support for Intel and AMD Ryzen processors). This is an essential component required for the correct display of data in the Your Computer tab.
Information: The PawnIo driver is installed only after explicit user consent and is required to read hardware sensors. SmoothWizard does not modify the driver nor distribute it without the user’s consent.
