Windows desktop, Mobile LAN, Footprint, Pro on pay.smoothwizard.com - system-optimization risk and liability.
Full EULA
End User License Agreement
Last update: 31.08.2026
Important: Read this End User License Agreement (“EULA”) before installing or using SmoothWizard software. Installing, launching, or using the Application / Mobile app means you accept this EULA. If you do not accept it - do not install or use the software.
Pro purchases and the Account are also governed by the Store Terms (pay.smoothwizard.com). Personal data: Privacy Policy.
1. Definitions
- Application - SmoothWizard software for Windows (desktop), including components, optimization scripts, the Mobile Companion server, and updates. Target distribution platform: Windows 10/11 x64; compatibility with specific hardware (Intel / AMD and others) is not guaranteed.
- Mobile app - SmoothWizard Mobile (iOS / Android) - a free companion that connects to the Application on the local network (LAN); it is not a separate paid product in app stores or on Pay.
- User - the individual or entity installing or using the Application / Mobile app.
- Basic (Free) Plan - free core features; Account login is not required to use Basic.
- Pro Plan - paid access to extended features (including Optimize System / Optimize Pro / game and app catalogs - as currently offered in the Application), usually after signing in with an Account that holds an active entitlement.
- Pro Trial - time-limited Pro access tied to the device Footprint (currently generally 7 days, without login) - per the Application / API mechanism.
- Footprint (HWID) - a device identifier derived from hardware characteristics (and possible fallback variants), used for licensing, trial, and “correct PC” checks.
- Account - an account on pay.smoothwizard.com linked to the Pro entitlement and Application sign-in.
- Store - the pay.smoothwizard.com payments and account service.
- Licensor - Artur Spychalski conducting business as SkullMedia Artur Spychalski, NIP 5922292367, REGON 524191477.
2. Licensor and contact
Licensor: SkullMedia Artur Spychalski (Poland). Contact: [email protected].
3. Grant of license
3.1. After accepting this EULA, the Licensor grants the User a non-exclusive, non-transferable, revocable, limited license to install and use the Application under the active plan (Basic / Pro / Trial / other entitlement shown in the Application).
3.2. As a rule, Pro / Trial entitlement is tied to one device (Footprint). The license server may deny access on Footprint mismatch (“Wrong PC” / sign-out). Device limits follow the Licensor’s offer and systems - not a multi-PC guarantee. If the User changes hardware configuration or device, they may re-bind the license (HWID / Footprint reset) within the technical limits set in the Account panel or by contacting support - this does not cover circumventing Trial limits or multi-PC use beyond the offer.
3.3. The Mobile app is licensed free of charge only as a companion to the Application on the same LAN; it does not by itself carry a Pro entitlement.
3.4. The license does not transfer ownership of the Application or its source code.
4. Plans, Account, payments
- Basic - no subscription fee; may communicate with the Licensor’s API (including device identification) as needed for operation and security.
- Pro - requires an active entitlement on the Account and Application sign-in (except Trial / any partner license per the offer).
- Purchase, renewal, withdrawal, and sales complaints: Store Terms and Stripe checkout on pay.smoothwizard.com. This EULA does not replace the digital-content sales contract.
- Basic / Pro feature scope may change with updates; the current description follows the Application and marketing site.
5. Pro Trial and abuse
- The Trial is time-limited and tied to Footprint (plus anti-abuse mechanisms, including API-side checks).
- A legitimate hardware change (e.g. motherboard, GPU, new PC) is not abuse: the User may request an HWID / Footprint reset under section 3.2. Repeatedly resetting Trial to extend free access remains prohibited.
- Circumventing Footprint, using generic / forged identifiers, repeatedly resetting the Trial, sharing Accounts to bypass limits, and other abuse is prohibited.
- Breach may result in Trial / Account / license blocks without refund except where mandatory law requires otherwise.
6. Technical requirements and system privileges
- The Application targets Windows (generally 10/11 x64). Other configurations - no warranty.
- The Application may require administrator privileges, Task Scheduler changes, firewall rules, and access to the registry, services, and processes.
- The User warrants they may lawfully modify the device and run a legitimate Windows installation.
- While running (including in the tray), the Application may send periodic presence signals to the license API (heartbeat, about every 2 minutes) - see Privacy Policy section 5.
7. System changes, optimization, and risk
Online game security systems: The Licensor does not guarantee that use of the Application (including optimisation features) will not be treated by third-party online game security systems as unauthorised interference. The risk of a game account ban or restriction rests with the Licensee. The Licensor is not liable for decisions of game publishers or operators of such systems, to the maximum extent permitted by law.
7.1. The Application may, among other things: change services and scheduled tasks, clean temporary files, create / switch power plans, block telemetry / hosts, change Windows privacy and UI settings, Windows Update, Game Mode, Game DVR, Fast Startup, network limits, remove UWP packages (debloat), change driver / game profiles (including NVIDIA tools), set CPU affinity, process priorities, suspend background processes, mask Explorer shell elements, and apply other optimizations described in the Application.
7.2. Such actions may cause OS or game instability, data loss, loss of Windows features, driver / security / network issues, or lower performance instead of higher. We do not guarantee higher FPS or any specific optimization result.
7.3. The Application may offer creating a System Restore point - creation depends on Windows System Protection and may fail. A restore point is not a full backup. Back up your data before optimizing.
7.4. The User acts at their own risk. To the fullest extent permitted by law, the Licensor is not liable for damage from optimization features, subject to § 14 (consumer rights / non-excludable liability).
8. Mobile app (LAN companion)
- The Mobile app connects to the Application on the local network only (UDP discovery and WebSocket; typically product ports for discovery and commands).
- Connection may use an optional PIN set in the Application. If the PIN is disabled / empty, LAN devices may gain access per the Mobile server configuration - the User is responsible for Wi-Fi / LAN security.
- LAN traffic may be unencrypted (ws://). Do not use the Mobile Companion on untrusted networks.
- The companion may send PC commands (including optimize, process list / kill, shutdown / restart / logoff / lock, hardware usage reads) and support Wake-on-LAN for saved hosts.
- No in-app purchases (IAP) and no Account login in the Mobile app - Pro remains on the PC / Pay.
- The desktop Application may open firewall rules for the Mobile server and listen on network interfaces - only when the User enables that feature.
9. Data, Footprint, Account, privacy
- The Application processes Footprint / HWID (and device technical data needed for licensing, trial, and diagnostics) and - when signed in - Account data sent to the Licensor’s API.
- Locally the Application stores settings, encrypted login data (when used), tray / Pro configuration, Mobile PIN, and other data under the app data folder (AppData).
- The Application communicates with Licensor servers (license / lists / updates APIs). Optionally the User may send a diagnostic (startup debug) report including system and hardware information - per consent / UI in the Application.
- Data categories, purposes, and recipients: Privacy Policy. This EULA does not replace the GDPR information notice.
- Hardware-monitoring components (e.g. LibreHardwareMonitor) and optional PawnIO may read sensors; PawnIO installs only after consent.
10. Updates and support
The Licensor may provide Application updates. Support (Discord / email / other channels on the site) is provided on a reasonable-effort basis and is not a guarantee of fixing every hardware setup. Lack of updates or limited support does not automatically create claims beyond mandatory law.
11. Intellectual property and restrictions
Prohibitions on decompilation, reverse engineering and similar acts apply to the fullest extent permitted by applicable copyright law, including Article 75(2) and (3) of the Polish Copyright Act (interoperability), where the statutory conditions are met.
- Application IP belongs to the Licensor / component licensors.
- Prohibited, among other things: copying, distributing, sublicensing, renting, reverse engineering, decompilation, circumventing license / Footprint protections - except where mandatory law allows (e.g. interoperability).
- Using the Application for unlawful acts or to infringe third-party rights is prohibited.
12. Termination and suspension
The license continues until terminated. The Licensor may suspend or end the license / Pro / Trial access for EULA breach, payment fraud, Trial abuse, security threats, or under the Store Terms. After termination the User must stop using and delete copies of the Application. Liability, IP, and governing-law clauses survive.
13. Third-party software
Open-source and external tools follow their own licenses (list below). The Licensor grants no broader rights to those components than their licenses allow.
14. Disclaimer of warranty and liability
Towards a Consumer (and a trader on consumer rights to the extent required by law) liability limitations apply only to the maximum extent permitted by mandatory Polish and EU law; statutory consumer rights remain unaffected.
- The Application and Mobile app are provided “as is” and “as available”, without merchantability, fitness for a particular purpose, or uninterrupted / error-free operation warranties - to the extent permitted by law.
- To the fullest extent permitted by law, the Licensor is not liable for indirect damages, lost profits, data loss, or OS/game damage arising from use of the software.
- We do not exclude liability that cannot be excluded toward consumers (in particular intentional harm or mandatory conformity / warranty rules where applicable).
- For non-consumer Users, the Licensor’s liability - where permitted - is limited to amounts paid for Pro in the 12 months before the event (or PLN 0 for Basic only), unless mandatory law provides otherwise.
15. Changes to this EULA
The Licensor may update this EULA. The current version is published on this page with a date. Continued use after changes may mean acceptance of the new version unless law requires separate consent. For material changes the Licensor will use reasonable efforts to notify in the Application / on the site / by email (when an address is held).
16. Governing law
This EULA is governed by Polish law. Mandatory consumer-protection rules of the User’s country of residence may also apply. Disputes follow general venue rules; consumers keep consumer-protective venue rights.
17. Entire agreement
This EULA together with the Privacy Policy and - where Pro is purchased - the Store Terms form the agreement for using SmoothWizard software. If any clause is invalid, the rest remains in force.
