Partnership Program Regulations

These terms describe the SmoothWizard affiliate program (partner panel: pay.smoothwizard.com).

1. General provisions

   • The affiliate program run by SkullMedia Artur Spychalski promotes the app through partner codes shared by participants.
   • Participation is voluntary and free of charge.
   • Partner accounts, balances, payout requests, and codes are managed in the SmoothWizard payment service (pay.smoothwizard.com), unless the organizer states otherwise.
   • Log in to the partner panel with your SmoothWizard Pay account (pay.smoothwizard.com) - there is no separate WordPress login.

2. Organizer

   • The organizer is Artur Spychalski conducting business as SkullMedia Artur Spychalski, tax ID (NIP) 5922292367, REGON 524191477.
   • Program contact: [email protected].

3. Eligibility and acceptance

   • Participants must be 18+ or a lawfully operating business.
   • Applying / activating a partner account and using codes means acceptance of these terms as in force at acceptance.
   • The organizer may refuse or suspend participation, especially in case of suspected abuse.
   • Admission is not automatic. Every application is reviewed by the organizer.
   • The organizer may publish recommended (non-binding) reach minima on platforms such as YouTube, TikTok and Twitch. Falling short of a recommendation is not an automatic refusal, and meeting it does not guarantee acceptance.
   • When deciding, the organizer considers among other things content quality, fit with the SmoothWizard app, accuracy of the application, and abuse risk.

4. Commissions and cash payouts

   • Payout hold: commission on a given order is automatically accepted (released for cash payout) after 14 days from accrual, provided there was no refund or chargeback in that period. If the payment was refunded, the commission is cancelled (reversed in the ledger) and does not count toward the withdrawable amount. During the hold, the amount may appear in the panel as funds in a waiting period.
   • Commissions accrue on sales attributed to the participant's partner code, per the partner panel settlement rules.
   • The minimum cash payout request is PLN 50 (or the equivalent in the balance currency if the panel uses one).
   • Cash payouts use methods available in the partner panel. Currently: BLIK and bank transfer, to the details provided in the request.
   • The participant is responsible for correct payout details (BLIK phone, IBAN, etc.).
   • The organizer may agree an individual settlement method with a given partner (payout method and cycle, invoice or credit note, currency, transfer details) - the same way as an individual commission rate and code discount. Terms are confirmed by email from the smoothwizard.com domain or in the panel.

5. Affiliate balance and Pro purchase

   • Commission balance cannot be used toward a Pro purchase in the shop (pay.smoothwizard.com) or in any other way except a cash payout. This is not the loyalty club (5% points).
   • The only and final way to realize partner balance is a cash payout (BLIK or bank transfer) after reaching the PLN 50 minimum. This rule will not change.

6. Verified partner and code changes

   • The Organizer may grant verified partner status (e.g. creators in a dedicated collaboration). Such a partner may receive an admin-assigned code and a public profile (name / handle, role, avatar, social links) shown with the code link.
   • Verified partner status means the code was assigned by the SmoothWizard team to that person - so users know who the discount comes from. Codes without this badge may come from various program participants; that does not automatically imply anything improper, but it does not provide the same identity assurance.
   • A verified partner may (with the Organizer's consent) appear on the marketing site Partners page.
   • The Organizer reserves the right to change, suspend, or withdraw partner codes - especially for dedicated creator collaborations, code rebranding, terms breaches, or operational reasons - with notice to the partner where reasonably possible.

7. Pay system rates (from 17 Aug 2026)

   • On 17 Aug 2026 it was decided that the new SmoothWizard payment system (pay.smoothwizard.com) no longer uses the legacy defaults of 25% buyer discount / 25% commission.
   • The change took effect with the transition to the new Pay system: by default a partner code gives the buyer a 20% discount and the partner a 20% commission (the Organizer may set a different rate for a specific code).
   • Commission is calculated on the net amount (excluding VAT). Only 23% VAT is deducted from the gross price. The partner settles income tax on commission themselves.

8. Multi-affiliate network (MLA) - optional, not the default

   • The standard affiliate program is flat: one partner, own codes, own commission. MLA (multi-level affiliate) is an optional network mode: a root partner and subordinates (one level below the root at most). MLA is not default and does not arise merely from having a partner account.
   • To request MLA, write only to [email protected] (subject e.g. “MLA request”). There is no self-service “enable network” switch. The organizer may ask for extra information (reach, cooperation model, invoice or payout details).
   • Whether to enable MLA, on what terms, and for how long is solely the organizer’s decision. The organizer may refuse, delay, or limit MLA. MLA starts only after terms are confirmed by email from the smoothwizard.com domain or in the partner panel - sending a request does not by itself create a network contract.
   • The network has two levels at most. A subordinate cannot have their own subordinates. There is no third or further level.
   • A subordinate attached to a given root cannot be moved to another network or switch roots without the Organizer's explicit prior consent confirmed by email from the smoothwizard.com domain.
   • Commission on a subordinate’s code sale is split from the root’s pool. It is not stacked on top of the organizer’s cost. Illustrative defaults (unless individual terms say otherwise): root pool 50% net, subordinate share 20% net (carved from that pool). Example: net 100, pool 50, share 20 - subordinate 20, root 30, 50 from the pool in total. The subordinate share cannot exceed the pool.
   • The buyer discount on a partner code remains a checkout discount (20% by default) and is not network commission.
   • Only a root with MLA enabled may request extra codes in the panel. Subordinates receive codes assigned by the root or the organizer. A first-time partner application is a separate process and does not replace an MLA request.
   • Root and subordinate balances are separate. Cash payout follows the minimum and hold in these terms, unless the panel or individual terms say otherwise.
   • Individual terms. MLA rules (pool size, subordinate share, number of codes, who is attached, currency, payout method and cycle, invoice or credit note, B2B vs individual, reporting) may be agreed individually with the root - the same way as an individual commission rate, code discount, and individual settlement method in the flat program. Confirmation: email from the smoothwizard.com domain or the panel. If they conflict, the individual confirmation prevails over the illustrative figures in this section, but it does not waive the prohibitions (self-referral, spam, brand bidding) or the character of the program.
   • Legal character of MLA. MLA is not a game of chance, a lottery, an investment product, or a promise of fixed income. Commission arises only from a real, paid sale of the SmoothWizard app or subscription attributed to a code, not from recruiting someone into the network as such. There is no fee to join the network or to occupy a “place” in the structure. MLA participation alone is not employment, a contract of mandate, or a commercial agency, unless the parties sign a separate agreement. Each participant accounts for tax and social contributions on commissions themselves.
   • MLA is entirely separate from the loyalty club (Punky Many points as a checkout discount, no cash payout). Club points are not partner commission and do not enter the MLA network.
   • The organizer may change, suspend, or end a given MLA arrangement (including detaching subordinates or disabling the network on an account) with notice where reasonably possible - especially in case of abuse, no sales, a terms breach, or operational reasons. Unpaid commissions are settled under the hold and refund rules.

9. Tax settlement

   • The program is open to adults (18+) and businesses. The organizer does not employ the Partner and does not enter into an employment or mandate contract merely by program participation. The Partner alone settles all tax and social-security duties arising from commissions under the law applicable to the Partner.
   • Participants must settle income from the program under applicable tax law themselves.
   • The organizer is not responsible if participants fail to meet tax obligations.
   • Payouts to individuals not running a registered business are made under a civil-law arrangement (advertising space / promotion). The resulting income is classified by the Partner as income from other sources and settled by the Partner in their own annual tax return (in Poland: PIT-36 or PIT-37).

10. Partner codes

    • Participants may hold and share partner codes via the panel (after application approval when required).
    • Codes may discount the buyer's price; partner commission is calculated on the net amount after the discount applied to that transaction (excluding 23% VAT), unless the panel states otherwise.
    • Partner codes are distinct from SmoothWizard one-time promotional (promo) codes.

11. Liability

    • The organizer may change these terms and suspend or end the program at any time.
    • Participants must follow these terms and applicable law (including no spam and no misleading discount claims).

12. Advertising disclosures (UOKiK / consumer law)

    • Participants must clearly label content with partner codes / links as advertising or paid collaboration, visible to the audience, in line with the Polish Competition Authority (UOKiK) recommendations on advertising disclosures (including affiliate marketing).
    • The organizer may require corrections or withhold commission / suspend the account for non-transparent or hidden advertising.

13. Prohibited conduct

    • Brand-bidding ban: the Partner must not bid in paid campaigns (including Google Ads, Bing Ads, Meta Ads) on keywords containing the SmoothWizard trademark or name, or confusingly similar phrases (including “SmoothWizard discount code”), nor impersonate the official SmoothWizard profile or store.
    • Commission may not be earned on purchases made by the Partner for their own use (self-referral), including via linked accounts, email addresses, payment cards, payment methods or devices.
    • Prohibited activities include spam, misleading claims about the app or discounts, fake reviews, self-referral to obtain commission, incentivized / bot traffic, and misleading use of SmoothWizard trademarks.
    • Breach may result in cancelled commissions, blocked codes, and removal from the program.

14. Personal data

    • Data processed for the program (account, payouts, sale attribution) is covered by the SmoothWizard privacy policy: Privacy policy.

15. Governing law

    • These terms are governed by Polish law. Disputes with Participants who are consumers are heard by the ordinary courts competent under the Polish Code of Civil Procedure (generally the court for the consumer's place of residence). For Participants who are not consumers (businesses), the court competent for the organizer's seat applies.

16. Complaints

    • Complaints about the program go to [email protected]; the organizer will review them within 14 days.

17. Changes to the regulations

    • The organizer may change these terms and will inform participants of material changes (including updating this page and/or a notice in the partner panel).
    • Payment-system changes (pay.smoothwizard.com) may require updates here - marketing copy should match current payout methods and balance rules.
